Welcome to ErgoSalah. By accessing or using our website, you agree to be bound by these Terms and Conditions. Please read them carefully before making a purchase.
Article 1 – Definitions
In these terms, the following definitions apply:
- Consumer: A natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
- Day: Calendar day.
- Right of Withdrawal: The ability of the consumer to withdraw from the distance contract within the reflection period.
- Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance (ErgoSalah).
- Distance Contract: A contract concluded between the entrepreneur and the consumer within the framework of a system for distance sales, using only distance communication techniques up to the conclusion of the contract.

Article 3 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these terms and conditions is made available to the consumer. If this is not reasonably possible, the entrepreneur will indicate, before the contract is concluded, how the terms can be inspected and that they will be sent free of charge at the consumer's request.
Article 4 – The Offer
If an offer is subject to a limited validity period or specific conditions, this will be explicitly stated.
The offer contains a complete and accurate description of the products and/or services. The description is sufficiently detailed to allow the consumer to make a proper assessment. All images, specifications, and data in the offer are indicative and cannot be grounds for compensation or dissolution of the agreement. The entrepreneur cannot guarantee that the colors displayed on your screen correspond exactly to the real colors of the products.
Article 5 – The Agreement
The contract is concluded at the moment the consumer accepts the offer and fulfills the associated conditions. If the consumer has accepted the offer electronically, the entrepreneur will confirm receipt of acceptance electronically.
The entrepreneur may, within legal frameworks, verify whether the consumer can meet their payment obligations, as well as facts and factors relevant to a responsible conclusion of the distance contract. If the entrepreneur has good grounds, they are entitled to refuse an order or attach special conditions to the execution.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the right to dissolve the contract without stating reasons within 14 days. This reflection period commences on the day after the consumer receives the product.
During the reflection period, the consumer must handle the product and packaging with care. The product should only be unpacked or used to the extent necessary to assess whether to keep it. If the right of withdrawal is exercised, the product must be returned with all accessories and in its original condition and packaging.
To exercise this right, the consumer must notify the entrepreneur via email at ergosalahrelief@gmail.com.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the costs of return shipping are for the consumer's account. If the consumer has made a payment, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after the withdrawal is processed and the product is received back.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur can exclude the right of withdrawal for products that are:
- Created by the entrepreneur in accordance with the consumer's specifications (custom-made).
- Clearly personal in nature.
- Of such a nature that they cannot be returned (e.g., hygienic products where the seal has been broken).
- Liable to deteriorate or expire rapidly.
Article 9 – The Price
Prices mentioned in the offer constitute the total price, but exclude potential import duties (see Article 11). Prices are subject to printing and typographical errors. No liability is accepted for the consequences of such errors. In the event of an error, the entrepreneur is not obliged to deliver the product at the incorrect price.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products comply with the agreement and the specifications stated in the offer. Any defects or incorrectly delivered products must be reported in writing to the entrepreneur within 14 days after delivery.
The warranty does not apply if:
- The consumer has repaired and/or modified the delivered products themselves.
- The products have been exposed to abnormal conditions or treated carelessly.
Article 11 – Delivery, Execution & Customs
The entrepreneur will take the utmost care when receiving and executing orders. The delivery address is the address provided by the consumer.
Goods may be shipped directly from a supplier in a third country (e.g., China). The entrepreneur does not handle the importation of goods into the destination country.
The customer is fully responsible for paying any import duties, taxes, and VAT that may be charged upon receipt of the goods. These costs are not included in the purchase price and are not calculated at checkout. The entrepreneur is not liable for delays caused by customs procedures.
Unless agreed otherwise, accepted orders will be shipped with due speed, but at the latest within 30 days. If delivery is delayed, the consumer will be notified and has the right to dissolve the agreement without costs.
Article 12 – Payment
Amounts due must be paid within 7 working days after the agreement is concluded. The consumer has a duty to report inaccuracies in provided payment details immediately to the entrepreneur.
Article 13 – Complaints Procedure
Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within 7 days after the consumer has discovered the defects.
Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. Disputes between the consumer and the entrepreneur are subject to Dutch law.
